01Seller information
These Terms and Conditions govern purchases made through the SkySwitch PRO online store at www.skyswitchpro.com (the “Online Store”). The Seller is SkySwitchPro – Rafał Trzebiński, a sole trader registered in the Polish Central Register and Information on Economic Activity (CEIDG), with business address at Uzdrowiskowa 60/2, 76-270 Ustka, Poland, VAT EU ID: PL8881445596 and REGON: 340005818. Email: support@skyswitchpro.com.
02Scope and customer status
These Terms apply to sales contracts concluded through the Online Store. Merely browsing the website does not create a sales contract or constitute acceptance of future changes to these Terms. A customer accepts the version of the Terms presented during checkout when placing an order. Mandatory rights granted to consumers by Polish law, applicable European Union law, or the law of the consumer’s country of habitual residence remain unaffected. Where Polish law grants selected consumer rights to a natural person acting for business purposes when the contract is not professional in nature for that person, those rights also apply.
03Products and compatibility
SkySwitch PRO products are electronic devices intended for compatible 10Micron mount systems and related observatory equipment. The product description, technical specification, compatibility information and included documentation form part of the offer and should be reviewed before ordering. Customers should select the correct hardware version and may contact the Seller if compatibility is uncertain. Product photographs are illustrative; minor differences in appearance or packaging are permitted only where they do not alter the product’s essential characteristics, functionality or conformity with the contract. Nothing in this section limits statutory rights where information supplied by the Seller is incorrect or incomplete.
04Ordering process and conclusion of the contract
Products displayed in the Online Store constitute an invitation to place an order. Before submitting an order, the customer can review and correct the selected products, quantities, delivery details and payment method. The final checkout control must clearly communicate that placing the order creates an obligation to pay. Submitting the order is an offer to purchase. Receipt of an automated message may only acknowledge that the order was received; the sales contract is concluded when the Seller sends an email expressly accepting the order or confirming dispatch. The Seller may decline an order for a legitimate reason, including unavailability, an obvious pricing error, failed payment, suspected fraud or inability to deliver. Any amount already collected for a declined order will be refunded without undue delay. The order confirmation and the applicable contractual information will be supplied by email or another durable medium.
05Prices, VAT and additional charges
Prices are stated in EUR unless the Online Store clearly indicates another currency. Before the order is submitted, checkout displays the total price payable, including applicable VAT and all delivery or other charges known to the Seller. Where charges cannot reasonably be calculated in advance, the method of calculation will be disclosed before purchase. For deliveries outside the European Union, import duties, taxes or customs charges may be payable by the recipient where clearly disclosed and permitted by law. Price changes do not affect orders already accepted by the Seller.
06Payment
Available payment methods are shown at checkout and may include card payment, digital wallets, PayPal or bank transfer. By selecting a payment method, the customer confirms that they are authorized to use it. Payments may be processed by independent payment service providers under their own terms and privacy notices. The Seller does not receive full card details. If payment is not completed or is reversed, the Seller may suspend fulfilment and, after giving any notice required by law, cancel the order.
07Shipping, delivery and transfer of risk
Orders are dispatched from Poland to destinations available at checkout. Available methods, costs and estimated delivery times are shown before purchase and are further described in the Shipping Policy. Unless another delivery time is agreed, consumer orders will be delivered without undue delay and no later than 30 days after the contract is concluded. The Seller remains responsible for delivery and for accidental loss or damage until the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods. This does not apply where the consumer independently commissions a carrier not offered by the Seller. If delivery is delayed, statutory remedies remain available.
08Consumer right of withdrawal
A consumer who concludes a distance contract may withdraw from it without giving a reason within 14 days. For goods, the period normally begins on the day the consumer, or a designated third party other than the carrier, receives the goods; where multiple goods are delivered separately, it begins on receipt of the last item. The right may also apply to qualifying sole traders where required by Polish law. Statutory exceptions apply, including for goods made to the consumer’s specification or clearly personalized and other cases listed by law; any relevant exception will be identified before purchase.
09How to withdraw and return goods
To exercise the right of withdrawal, the customer must send an unequivocal statement before the deadline to support@skyswitchpro.com or to the Seller’s postal address. The model form below may be used but is not mandatory. Goods must be returned no later than 14 days after the withdrawal statement is sent. Unless the Seller agrees otherwise or failed to provide the required information, the customer bears the direct cost of returning the goods. The customer is responsible only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
10Refund following withdrawal
The Seller will refund payments received from the consumer, including the cost of the least expensive ordinary delivery method offered for the order, without undue delay and no later than 14 days after being informed of the withdrawal. The Seller may withhold the refund until the returned goods are received or the consumer supplies evidence of return, whichever occurs first. The refund will be made using the original payment method unless the consumer expressly agrees otherwise and incurs no fee. Additional delivery cost resulting from the customer’s choice of a more expensive method is not refundable beyond the cost of the least expensive ordinary method.
11Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.

12Non-conforming or defective goods
The Seller is responsible for goods that do not conform to the sales contract under applicable consumer law. Under Polish law, this responsibility generally lasts for two years from delivery. A consumer may request repair or replacement, subject to the statutory rules on impossibility and disproportionate cost. Where the legal conditions are met, the consumer may request an appropriate price reduction or withdraw from the contract. Repair or replacement, including necessary postage, transport, labour and materials, is performed at the Seller’s cost. Any commercial or manufacturer warranty is additional and does not replace or restrict these statutory rights.
13Complaints procedure
Complaints may be submitted by email to support@skyswitchpro.com or by post to the Seller’s address. The complaint should identify the order and describe the lack of conformity and the requested remedy; a receipt is helpful but is not the only acceptable proof of purchase. The Seller will respond to a consumer complaint within 14 days of receipt. Customers should not send goods back for complaint handling until return instructions have been agreed, unless applicable law provides otherwise. Further practical information may be provided in the Returns & Refunds Policy; that policy cannot reduce statutory rights.
14Software, firmware and updates
Where software, firmware or digital documentation is supplied with a product, the customer receives a non-exclusive, non-transferable licence to use it with the product for its intended purpose, subject to any separate licence terms disclosed before purchase. The Seller will provide updates required to maintain conformity or security for the period required by applicable law and will provide reasonable installation instructions. Customers should install notified updates within a reasonable time. Failure to install a properly supplied update may affect remedies only to the extent permitted by law.
15Safe and intended use
SkySwitch PRO is specialist observatory equipment. Installation, configuration and operation must follow the supplied documentation, electrical ratings, compatibility guidance and safety notices. The product must not be used for life-support, safety-critical or other applications for which it was not designed. Unauthorized modification, incorrect wiring or use outside the published specification may damage the product or connected equipment. These requirements do not exclude the Seller’s responsibility for defects, misleading instructions or other liability that cannot lawfully be limited.
16Intellectual property
Website content, trademarks, graphics, product images, manuals, software and design elements are owned by the Seller or its licensors and are protected by intellectual property law. Customers may use supplied documentation and software for personal or internal business use with the purchased product. Except where mandatory law permits otherwise, content may not be reproduced, distributed, modified, sublicensed, reverse engineered or used commercially without prior written permission.
17Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, deliberate misconduct, product liability, breach of mandatory consumer rights, or any other liability that cannot legally be excluded. Subject to those limitations, the Seller is not responsible for losses caused solely by use contrary to the documentation, incompatible third-party equipment, unauthorized modification, or events outside the Seller’s reasonable control. Any limitation applicable to business customers will apply only to the extent permitted by law and will not affect rights granted to consumers or qualifying sole traders.
18Privacy and personal data
Personal data is processed for order fulfilment, payment, delivery, customer support, accounting, fraud prevention and compliance with legal obligations. Detailed information about legal bases, recipients, retention periods and data-subject rights is provided in the Privacy Policy. Payment and delivery providers process data under their own privacy notices where they act as independent controllers.
19Changes to these Terms
The Seller may update these Terms for future use of the Online Store, for example because of legal, technical or operational changes. The version accepted when an order is placed governs that order. Changes do not retroactively alter concluded sales contracts or reduce acquired consumer rights. Updated Terms take effect from the date shown on the website; continued browsing alone does not amend an existing contract.
20Governing law and dispute resolution
These Terms and sales contracts are governed by Polish law, without depriving a consumer of mandatory protection granted by the law of the country in which the consumer habitually resides. Courts are determined by mandatory jurisdiction rules. Customers are encouraged to contact the Seller first. Consumers may also seek assistance from a competent consumer ombudsman, the Polish Trade Inspection’s consumer ADR bodies, or the European Consumer Centre in their country. If a consumer complaint is rejected, the Seller will provide the information required by law about whether it agrees to participate in an out-of-court dispute resolution procedure.
